Nicole Bergstrom is a partner in the Litigation Group, where she concentrates her practice on complex commercial litigation. She represents clients in high-stakes business disputes involving breach of contract, business torts, antitrust, false advertising, copyright, right of publicity, defamation, and other reputational and regulatory issues. Nicole is known for her strategic litigation skills and her ability to navigate multifaceted legal and factual challenges across a wide range of industries.
Her clients include corporations, media companies, advertising agencies, manufacturers, and creative professionals. She has extensive experience managing litigation in both state and federal courts, including trial and appellate proceedings.
Nicole has been recognized in the 2024 edition of Best Lawyers with the "Ones to Watch" award, and as a 2023-2024 "Rising Star" and in the 2025 edition of Super Lawyers magazine.
Representative matters include:
- Prosecuting antitrust, false advertising, and unfair competition claims on behalf of a manufacturing client in a competitor dispute;
- Representing a theatre company in a jury trial involving commercial and tort claims brought by a former musician;
- Defending a publishing company in mulitiple commercial disputes, including copyright infringement, and appeals before the Second Circuit;
- Representing an advertising agency in litigation involving defamation and employment-related claims.
Nicole is admitted to practice in the New York state courts, the U.S. District Courts for the Southern, Eastern, and Northern Districts of New York, the U.S. Courts of Appeals for the Second and Ninth Circuits and the Supreme Court.
